Acceptance of Terms
RFID Journal LLC. ("RFID Journal"), and its site RFID Connect, provide our Internet
sites and the content, products and services offered on or through those sites (collectively,
the "Services"), to you subject to the following Terms of Service ("TOS"). Your
use of the Services in whole or in part constitutes your binding acceptance of these
TOS. If you do not agree to these TOS, you should not use the Services. Some Services
may be subject to additional posted rules, policies and terms. When you use those
Services, you and RFID Connect shall be subject to those additional conditions,
which are incorporated by reference into these TOS (and, consequently, form part
of your agreement with us). Other Services may be governed by different usage terms.
In the event of an inconsistency between these TOS and any additional posted conditions
or separate usage terms, the provisions of the additional conditions and/or separate
usage terms shall control. Because we may modify all or any part of these TOS from
time to time without notice to you, you should check back often so you are aware
of your current rights and responsibilities. Your continued use of a given Service
after changes to the TOS have been published on that Service constitutes your binding
acceptance of the updated TOS. If at any time the TOS are no longer acceptable to
you, you should immediately cease all use of the Services.
Our Commitment to Privacy
Your privacy is important to us. To better protect your privacy we provide this
notice explaining our online privacy policy and your acceptance by using RFID Connect.
To make this notice easy to find, it is available on our homepage and at every point
where personally identifiable information may be displayed.
Your Participation on RFID Connect.
Your participation on RFID Connect is voluntary. There is no charge to
use RFID Connect's basic services, which includes it's internal email system and
public message forums. By using RFID Connect you agree to release any liability
against RFIDConnect.com, it's parent company RFID Journal LLC, and it's advertisers,
including it's partners and it's event producer. If at any time you do not agree
with our statement of use or TOS, you may delete yourself from RFID Connect by clicking
on "YOUR PROFILE" in the top right corner of the page, then "ACCOUNT SETTINGS",
followed by the link to Remove and Delete your membership.
Statement of use.
This site has been provided as a service to people who visit this site. In some
cases, people are invited to join this site or are given a free account on this
site because they are attending or exhibiting at our partner’s tradeshow or event.
RFID Connect does not monitor and is not responsible for any content on this site
which is provided by any person other than RFID Connect. RFID Connect, nor it’s
partners cannot vouch for the accuracy or propriety of any information or comments
contained herein and disclaim any liability related to this website. Any concerns
related to the content or format of this website should be directed to RFID Connect
by using our "Contact Us" link at the bottom of this page.
Member Conduct.
You understand that all information, data, text, software, music, sound, photographs,
graphics, video, messages, tags, or other materials ("Content"), whether publicly
posted or privately transmitted, are the sole responsibility of the person from
whom such Content originated. This means that you, and not RFID Connect or it's
partners, are responsible for any Content that you upload, post, email, transmit
or otherwise make available via the Service. RFID Connect does not control the Content
posted via the Service and, as such, does not guarantee the accuracy, integrity
or quality of such Content. You understand that by using the Service, you may be
exposed to Content that is offensive, indecent or objectionable. Under no circumstances
will RFID Connect or it's partners be liable in any way for any Content, including,
but not limited to, any errors or omissions in any Content, or any loss or damage
of any kind incurred as a result of the use of any Content posted, emailed, transmitted
or otherwise made available via the Service.
You agree to not use the Service to:
Upload, post, email, transmit or otherwise make available any Content that is unlawful,
harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene,
libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise
objectionable;
Harm minors in any way;
Impersonate any person or entity, including, but not limited to, an RFID Connect
or it's partners official, a forum leader, guide or host, or falsely state or otherwise
misrepresent your affiliation with a person or entity;
Forge headers or otherwise manipulate identifiers in order to disguise the origin
of any Content transmitted through the Service;
Upload, post, email, transmit or otherwise make available any Content that you do
not have a right to make available under any law or under contractual or fiduciary
relationships (such as inside information, proprietary and confidential information
learned or disclosed as part of employment relationships or under nondisclosure
agreements);
Upload, post, email, transmit or otherwise make available any Content that infringes
any patent, trademark, trade secret, copyright or other proprietary rights ("Rights")
of any party;
Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized
advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid
schemes," or any other form of solicitation, except in those areas (such as shopping)
that are designated for such purpose (please read our complete Spam Policy);
Upload, post, email, transmit or otherwise make available any material that contains
software viruses or any other computer code, files or programs designed to interrupt,
destroy or limit the functionality of any computer software or hardware or telecommunications
equipment;
Disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other
users of the Service are able to type, or otherwise act in a manner that negatively
affects other users' ability to engage in real time exchanges;
Interfere with or disrupt the Service or servers or networks connected to the Service,
or disobey any requirements, procedures, policies or regulations of networks connected
to the Service;
Intentionally or unintentionally violate any applicable local, state, national or
international law, including, but not limited to, regulations promulgated by the
U.S. Securities and Exchange Commission, any rules of any national or other securities
exchange, including, without limitation, the New York Stock Exchange, the American
Stock Exchange or the NASDAQ, and any regulations having the force of law;
Provide material support or resources (or to conceal or disguise the nature, location,
source, or ownership of material support or resources) to any organization(s) designated
by the United States government as a foreign terrorist organization pursuant to
section 219 of the Immigration and Nationality Act;
"Stalk" or otherwise harass another; and/or
Collect or store personal data about other users in connection with the prohibited
conduct and activities set forth in the paragraphs above.
You acknowledge that RFID Connect and it's partners may or may not pre-screen Content,
but that RFID Connect and its designees shall have the right (but not the obligation)
in their sole discretion to pre-screen, refuse, or move any Content that is available
via the Service. Without limiting the foregoing, RFID Connect and its designees
shall have the right to remove any Content that violates our policies or is otherwise
objectionable. You agree that you must evaluate, and bear all risks associated with,
the use of any Content, including any reliance on the accuracy, completeness, or
usefulness of such Content. In this regard, you acknowledge that you may not rely
on any Content created by RFID Connect or submitted to RFID Connect, including without
limitation information in RFID Connect Message Forums and in all other parts of
the Service.
You acknowledge, consent and agree that RFID Connect may access, preserve and disclose
your account information and Content if required to do so by law or in a good faith
belief that such access preservation or disclosure is reasonably necessary to: (a)
comply with legal process; (b) enforce our Privacy Policy and Statement of Use;
(c) respond to claims that any Content violates the rights of third parties; (d)
respond to your requests for customer service; or (e) protect the rights, property
or personal safety of RFID Connect, its users and the public.
You understand that the technical processing and transmission of the Service, including
your Content, may involve (a) transmissions over various networks; and (b) changes
to conform and adapt to technical requirements of connecting networks or devices.
You understand that the Service and software embodied within the Service may include
security components that permit digital materials to be protected, and that use
of these materials is subject to usage rules set by RFID Connect and/or content
providers who provide content to the Service. You may not attempt to override or
circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction,
publication, further distribution or public exhibition of the materials provided
on the Service, in whole or in part, is strictly prohibited.
The information we collect:
Business Card Information
In order to make it easier for people to network and to facilitate meetings, RFID
Connect collects information typically found on a person's business card. By default,
business card details are hidden until the person grants someone access to their
information using controls found on the YOUR PROFILE link located at the top of
the page. You have three options for controlling your business card information:
1) Don't show it to anyone, 2) Make it public and allow anyone to see it and 3)
Only allow people on your contact list to see it. In addition to the business card
information, we do show everyone your personal information that would normally appear
on your badge at a tradeshow. This information includes:
>> Full Name, Title, Company Name, City, State & Country
If you grant someone rights to view your business card information or if you grant
everyone to view your business card, then it's like giving every single participant
at this event, your business card. This information includes, but is not limited
to:
>> Full Name, Title, Company Name, Complete Address, Email Address, Phone, Fax,
and all other information included in the Business Card Information section on your
"Profile" page.
Social media links, "instant message" accounts and other external links.
As an option, you may add links your personal links to other social network sites,
such as Facebook, LinkedIn, FlickR, your website or blog. We may add additional
links to other sites from time to time without notice. If you choose to complete
this section, we will disclose these links to all of our members. By adding links
to your social networking sites, you are asking RFID Connect to promote these links
to our members.
Other information we collect
In order to assist RFID Connect participants in planning, participants can click
on links throughout the site to indicate which sessions they plan to attend, people
they would like to meet, exhibitors they plan to visit, products and giveaways (treasures)
they're interested in, in addition to other traceable links we may have added in
order to help you build your Daily Planner.
How We Use Information:
RFIDConnect.com is an event specific social networking application designed to provide
an easy way to meet other people, attending the same event, on the internet. Members
create a profile and are then paired with a number of other members based on their
pre-selected profile criteria. Attendees and Exhibitors can see the full name, title,
company, city, state and country of each participant on RFID Connect. However, the
balance of the contact information is hidden. RFID Connect participants can grant
one or all members on RFID Connect access to their business card detail if they
desire. This is often done in order to improve business networking opportunities.
When participants indicate they "Plan to visit" a specific exhibitor, the exhibitor
is also given access to this information so they can follow-up and schedule a meeting.
Exhibitors are not given the attendee's business card information unless the attendee
has given them rights to view this information.
When participants indicate they plan to attend a specific session, others can also
view the list of people attending a specific session.
When you view exhibitor details, press releases, products and treasures we note
this information and give exhibitors access to who is viewing their information.
Exhibitors have the ability to contact attendees who have shown interest in their
products.
If you give access to your business card to everyone, you understand that others
can print, download or capture this information and use it beyond our control, just
as if you set a stack of business cards on an open table at the event.
RFIDConnect.com is not a closed service. It is a social networking application designed
to promote interaction and an exchange of information. You should not have any assurances
of privacy on this site, if you are concerned about your privacy we recommend your
leave this community by removing your profile. You may delete and remove your profile
by clicking on the "YOUR PROFILE" link located at the top of every page (once you
have logged in), then clicking on ACCOUNT SETTINGS and locating the "Remove and
Delete your membership" link located in the MANAGEMENT section on that page.
Public Message Forums
Some of our Services give users the opportunity to participate in Forums operated
by RFID Connect or by a third party. We ask that our users exercise appropriate
caution when participating in any type of Forum. In particular, please remember
that if you publicly disclose personal identifying information, such as your name
or email address, in connection with a Forum, the information may be collected and
used by others. You should also take reasonable precautions with regard to any material
you download from or through Forums (for example, scanning for viruses or other
damaging computer programming routines). Finally, you agree to use the Forums only
to send and receive messages and material that are proper and related to that particular
Forum.
Content available to search engines, including but not limited to Google, Bing, and
Yahoo!
Search engines index the content found on this site. If your business card
information is hidden, we use standard industry practices to not disclose this information
to automated search robots. However, we can not guarantee this information
will not be indexed. If you ever allowed this information to be viewed by the public,
or linked your business card information to other content on our site, then search
robots will likely find it and add it to their searchable content. If at any time
you don't want any of your content available to a search engine you should DELETE
your profile from RFID Connect. If you add your content and then later delete
your content from RFID Connect, search engines "could" cache this old
information indefinitely. RFID Connect has no control how search engines may use
the information you added to RFID Connect.
Indemnification
You hereby agree to indemnify, defend and hold RFID Journal LLC, RFID Connect, it's
partners, its subsidiaries, parent corporation and affiliates, and all of their
respective officers, directors, owners, employees, agents, licensors, representatives,
licensors and suppliers (collectively, the "RFID Connect Parties"), harmless from
and against any and all liability, losses, expenses, damages and costs (including
attorneys' fees), incurred by any RFID Connect Party in connection with any claim
arising out of your use of the Services, any use or alleged use of your accounts
or your passwords by any person, whether or not authorized by you, the content you
submit, post, transmit or make available through the Services, your violation of
these TOS, your connection to the Services, or your violation of the rights of any
other person or entity.
RFID Connect reserves the right to assume, at its sole expense, the exclusive defense
and control of any claim, action or other matter for which you are required to indemnify
us, and all negotiations for settlement or compromise thereof, and you agree to
fully cooperate with RFID Connect in the defense of any such claim, action, settlement
or compromise negotiations, as requested by RFID Connect.
Disclaimers of Warranties
THE SERVICES, AND MATERIALS, PRODUCTS AND POSTINGS ARE MADE AVAILABLE ON AN "AS
IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY REPRESENTATION, PROMISE OR WARRANTY OF
ANY KIND, EXPRESS OR IMPLIED, OR ANY GUARANTY OR ASSURANCE THE SERVICES WILL BE
AVAILABLE FOR USE, OR UNINTERRUPTED OR ERROR FREE, OR THAT ALL PRODUCTS, FEATURES,
FUNCTIONS OR OPERATIONS WILL BE AVAILABLE OR PERFORM AS DESCRIBED OR THAT ANY ERRORS
WILL BE CORRECTED. IN ADDITION, ANY MATERIAL THAT YOU DOWNLOAD OR OTHERWISE OBTAIN
THROUGH OUR SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY
RESPONSIBLE FOR ANY POTENTIAL DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT
RESULTS FROM YOUR DOWNLOAD OF ANY SUCH MATERIAL. Without limiting the foregoing,
RFID Connect is not responsible or liable for any malicious code, delays, inaccuracies,
errors, or omissions arising out of your use of the Services. As between you and
RFID Connect, you are assuming the entire risk as to the quality, accuracy, performance,
timeliness, adequacy, completeness, correctness, authenticity, security and validity
of any and all features and functions of the Services, including, without limitation,
postings and materials associated with your use of the Services. Under no circumstances
shall any RFID Connect Party be liable for any loss or damage caused by your reliance
on information obtained through the Services. It is your responsibility to evaluate
the information, opinion, advice, or other content available through the Services.
Limitation of Liability
IN NO EVENT SHALL ANY RFID CONNECT PARTY BE LIABLE TO YOU OR ANY OTHER PERSON OR
ENTITY, UNDER ANY THEORY, INCLUDING NEGLIGENCE, FOR DAMAGES OF ANY KIND ARISING
FROM THE USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, ACTUAL,
INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, LOST INCOME, REVENUE OR
PROFITS, LOST OR DAMAGED DATA, OR OTHER COMMERCIAL OR ECONOMIC LOSS, THAT RESULT
FROM YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF SUCH RFID CONNECT PARTY
HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR SUCH DAMAGES ARE FORESEEABLE.
BY USING THE SERVICES, YOU AGREE THAT THIS LIMITATION WILL APPLY TO ANY MERCHANDISE,
SERVICES, AND CONTENT THAT MAY BE AVAILABLE THROUGH SUCH SERVICES. IN THE EVENT
THAT APPLICABLE LAW DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR DAMAGES,
YOU AGREE THAT IN NO EVENT SHALL THE TOTAL LIABILITY OF ANY RFID CONNECT PARTY TO
YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION OF ANY KIND EXCEED ONE HUNDRED
DOLLARS ($100.00). Notwithstanding any claim that a sole or exclusive remedy which
is provided in this agreement may or does fail of its essential purpose, you specifically
acknowledge and agree that your sole and exclusive remedy for any loss or damage
shall be to have RFID Connect, upon written notice from you to us, attempt to repair,
correct or replace any deficient Service and, if repair, correction or replacement
is not reasonably commercially practicable for RFID Connect, in its sole discretion,
to refund any monies actually paid by you for the Service involved and to terminate
and discontinue your use of the Services.
Our Commitment to Data Security:
To prevent unauthorized access, maintain data accuracy, and ensure the correct use
of information, we have put in place appropriate physical, electronic, and managerial
procedures to safeguard and secure the information we collect online.
Expectation of privacy in email.
Members may have an expectation of privacy when using RFID Connect's built-in email
engine. However, the security and safety of our membership will always take priority
over privacy when it comes to complaints of stalking or harassment by anyone using
RFIDConnect.com. Our management reserves the right to review private email if, in
our sole opinion, any member of RFIDConnect.com is being stalked, harassed or spammed
by our membership. We also reserve the right to audit email or provide law enforcement
authorities access to email logs if, in our sole opinion, RFIDConnect.com was used
to defraud or cause harm to another. Finally, we will always work fully with law
enforcement agencies by providing any and all information provided, including IP
address logs to RFIDConnect.com in the event a member uses a stolen credit card
to purchase premium services on RFIDConnect.com.
How You Can Access or Correct Your Information:
You can access all your personally identifiable information that we collect online
and maintain by logging on with your email address and password and editing your
personal profile. We use this procedure to better safeguard your information.
You can correct factual errors in your personally identifiable information by logging
in and clicking on "YOUR PROFILE" to update your information.
